There will be some emphasis on the legal skills, including advocacy and dispute resolution. Topics include: l The English common law foundations; l The origins ofAustralia's common law system; l Features of common law and civil law systems; l Constitutions in a common law system; l Judges, barristers and solicitors; l The theory of precedent; l The hierarchy of courts; l Statutory interpretation in a common law system; l Technology’s impact on the common law. l 高级法律研究与写作 Advanced Legal Research and Writing The areas examined include: methodologies of legal research; methodologies of legal drafting; utilization of the methodologies in an advanced theoretical framework 国际组织(WTO) International Organizations (WTO) International Organizations such as the WTO, WIPO, UNCTAD, and UNCITRAL play a pivotal role in the promotion and facilitating of world trade. The purpose of this subject is to introduce students into the overall international trade framework and the policy, and operational roles played by key international organizations and the consequent legal issues which emerge from their operation. 关贸总协定与世界贸易组织法 GATT/WTO Law This subject aims to enhance students' understanding of GATT/WTO law. The subject examines the role of GATT/WTO law in the regulation of international commerce, with particular emphasis on valuation, tariff, rules of origin and anti-dumping. Importance is placed on computer-based research. 国际商法 Intl Commercial Transactions Law The object of this subject is to provide students with an understanding of the legal environment in which international trade and commerce are conducted by business entities in both civil and common law countries. The course will examine the private and public law aspects of international trade and commerce. The private law component will deal with transactions, such as sale of goods, forms of payments, and related issues such as customs, shipping law and insurance law and private international law aspects with particular reference to dispute resolution. The public law component will consider the impact of international obligations, both multilateral and bilateral, on the conduct of trade and commerce. It will also consider the principles of international law relating to contracts and dispute settlement and arbitration. 知识产权法 Intellectual Property Law This subject introduces students to the principles and concepts of intellectual property law, including the dynamic fields of copyright, trademark, and patent law, with particular emphasis on the way in which intellectual property rights are regulated in the international trading environment. The subject also includes an examination of intellectual property law as it relates to unfair competition, trade secret law, misappropriation and rights of publicity. Students in this subject will be provided with the essential knowledge and awareness to apply the principles of intellectual property law to the work environments in which they operate. Given the rapidly changing nature of this area of study the curriculum will be negotiated to suit the particular needs of the class. 竞争政策与法律 Competition Policy & Law This subject will examine the nature and scope of competition laws in theUS,China, EU and elsewhere and the policy basis behind those laws and will also compare those laws with other selected national laws and relate those laws to the international trading environment. 国际争端解决 International Dispute Resolution This unit examines the causes, processes and outcomes of international disputes. We will attempt to develop a framework within which international disputes may be analyzed. We focus on disputes which threaten the peace, using current examples wherever possible. Legal doctrine will be considered in light of political interests and the contemporary structure of the international community.
